Online Probate

Probates are a tedious process that take up a lot of time and effort and the application is completed by an Executor/trix. By using the Executors Vault Probate System, we will guide you to apply and complete a successfully probate the first time around. We have taken the time to review probates applications and by completing our sequence of forms we will prepare an online probate for you and even submit it. What do I need to know as an Executor/trix?

FIRST, you must determine if the Application to the provincial court for a 'letter of probate' is necessary by talking to the holders of the assets, once you have confirmed you require a 'letter of probate' complete our online probate application. (Coming Soon!)  If you are still not sure if you need to file a 'letter of probate' you may contact us.

Then you must:

  • Complete the list of valuables with any amounts owed & owned by the deceased only, do not include joint ownership items that you have verified they are converted to the joint owner automatically.
  • Provide the listing of valuables and amounts owed to the tax accountant and lawyer.
  • Record the source of information used to evaluation the value and amounts owed and owned and maintain a paper copy of such evaluation if possible.
  • Contact the beneficiaries listed as soon as possible to obtain their address and social insurance number as anticipated payment to the beneficiaries does provide justification for collecting this information.
  • Confirm the due dates as soon as possible for all tax and government regulatory filing needs.
  • Set up a session with a tax accountant and / or solicitor as soon as you discover you have been named as the executor of a deceased.

 

What MUST an Executor/trix do?

 

  • Contact all beneficiaries (as per Will) & all payees regarding the death
  • Consider selected capital gains and losses on assets transferred to spouse or spousal trust without tax considerations to deceased.
  • Take steps to minimize the changes in assets & liabilities balance. (ie: fixed investments & loans)
  • Consider filing separate income tax returns to multiply credits.
  • Be careful of any foreign estate taxes.
  • Obtain a clearance certificate before distributing assets.
  • Locate the previous 3 yrs tax returns with tax slips and review the source of issuers on slips. Provide copies to a tax accountant.
  • Maintain a vehicle log on trips endured for the estate listing the address, the distance travelled including return distance, the date and the purpose.
  • Obtain at least 5 death certificates from the funeral home.
  • Maintain a paper copy of any disbursement you have endured for the estate, whether it was paid by the estate bank or your cash.

 

How does the Application process work?

If you have been appointed Executor/trix of a Will you can purchase the Online Probate Application form for the Province/State the deceased resided in. We will then provide you with a checklist of all the information we require for your probate application.  (Both Coming Soon!)

How much does the Application cost?

We charge $695.00 for your application.  We have determined that on average it would cost you approximately $2500.00 to complete your application with other resources - same service.
